Consent Procedure  

Government of India have enacted the Water (Prevention and Control of Pollution) Act,1974 and Air (Prevention and Control of Pollution) Act, 1981 for prevention, control and abatement of water and air pollution.  As per the said Acts, no person shall establish or take any steps to establish any industry, operation or process, or any treatment and disposal system or an extension or addition thereto, which is likely to discharge sewage or trade effluent into a stream or well or sewer or on land or air pollutants into the atmosphere without the previous consent of the Pollution Control Committee.

Any person who wants to establish any industry in the Union Territories of Daman & Diu and Dadra & Nagar Haveli shall make applications in Form XIII and/or Form I along with the consent fee as mentioned in Consent Fee Structure and documents as per the Check List-Establish for that particular category of industry. After scrutiny of the application and site inspection, wherever  necessary , the Pollution Control Committee may grant 'consent to establish' subject to certain conditions or reject the application.

Similarly for obtaining the Consent to operate  the industry of facility, After its establishment as per the project report, the applicant shall make application in Form XIII and Form I along with the consent fee and documents as per  the Check List-Operate.  Before issuing the consent to operate units are inspected to record the compliance of conditions imposed in the consent to establish.

If the entrepreneur is not  able to establish the unit within the limited validity period, the same has to be got extended by applying in the similar to consent to establish. Similarly, the 'operate consent' has to be renewed at periodic intervals. On payment of fees the consent to operate can issued as under.
